Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("User", "Creator", "Buyer", or "you") and Shirt Bazaar, Inc. ("Shirt Bazaar", "we", "us"). They govern your use of our website, generation studio, storefront infrastructure and physical fulfillment (the "Platform").

By registering, generating, uploading, claiming, or buying, you agree to these Terms. Our Privacy Policy and Cookie Notice explain how we handle personal data and browser storage. Together they form the entire agreement between you and Shirt Bazaar about the Platform, and replace any earlier version.

2.1 Eligibility: You must be at least 18, or the age of majority where you live, to hold an account, generate content, claim designs or transact. Signing up requires you to confirm this. By using the Platform you represent that you have the legal capacity to be bound by these Terms.

2.2 Account Responsibilities: Give accurate information at signup and keep your credentials secure. You are responsible for activity under your account. Email support@bazaar.america.co immediately if you suspect unauthorized access.

2.3 Handles: Your public handle (/yourhandle) may be reclaimed or suspended if it infringes a trademark, impersonates someone, or breaches our Acceptable Use standards.

3.1 Quota: Each account gets a free weekly allowance of generations at standard settings, currently 7 per rolling 7 days, as shown on the Pricing page. Higher quality or resolution, and any generation beyond the free allowance, draw from a paid credit balance. The studio shows the price before you generate. Unused allowance does not roll over, and we may change the allowance for future periods.

3.2 Style References: You warrant you hold the rights to any image you upload for style conditioning. Do not upload third-party copyrighted art, trademarks, private portraits, or infringing material.

3.3 Privacy of Drafts: New designs are stored privately in your studio. They become publicly discoverable only when you publish them or a claim occurs.

4.1 Permanence: Every design is a true 1-of-1. Once claimed, it is locked to that claimant permanently: no second edition or duplicate is ever minted.

4.2 Rights Assignment: On settlement of a claim, Shirt Bazaar assigns the claimant an irrevocable, worldwide, exclusive, royalty-free (subject to Section 5.4) commercial license and copyright in the artwork. You own the commercial rights.

4.3 Our Display License: To run the marketplace and your storefront, you grant us a non-exclusive, royalty-free license to host, index and mock up the claimed design on our properties and marketing.

Full scope, AI-authorship limits, and the license we keep are set out in Section 5.

5.1 Assignment: On completion of a Genesis Claim, Shirt Bazaar, Inc. irrevocably assigns the claimant all right, title and commercial interest, including applicable copyright, in the claimed artwork.

5.2 What You May Do: As rights holder, you may:

• Sell merchandise through your storefront or any third-party channel.
• Manufacture apparel, prints or media carrying the design.
• Sub-license, assign or sell the rights outright, with no clawback by us.
• Keep it: beyond the claim price, no ongoing royalty is owed to us or the maker.

5.3 Our Display License: You grant Shirt Bazaar a non-exclusive, royalty-free, worldwide license to host, format and index the artwork to run the service. It gives us no ownership and no right to license your design to anyone else.

5.4 Maker Royalty: If the design you claim was made by another user, that maker receives a royalty on your claim price, once, when your claim completes, at the rate set out in Section 8.

5.5 Limits of AI Authorship: This artwork is machine-generated from your prompts and references. Whether AI output attracts copyright protection is unsettled and varies by jurisdiction. The U.S. Copyright Office currently requires human authorship for registration. We assign you everything we hold; registrability elsewhere is a limit of the law, not a reservation of rights by us.

When you upload media or prompts, you represent that:

• You hold the rights needed for us to process it.
• It infringes no copyright, trademark, patent, trade secret or privacy right.
• It does not deliberately imitate registered trademarks or proprietary characters.

You agree to defend and indemnify Shirt Bazaar and its officers against third-party claims arising from your breach of these warranties. Nothing here limits a right you hold as a consumer that cannot be waived under your local law.

7.1 Provisioning: On claim, we automatically provision a storefront at bazaar.america.co/yourhandle with mockups, sizing and checkout ready to go.

7.2 Zero-Inventory: We handle payment processing, order dispatch, print-on-demand fulfillment and quality control on your behalf.

7.3 Governance: You may customize your storefront's name, bio and socials, subject to our content standards. We may suspend storefronts that use deceptive practices or prohibited content.

8.1 Mechanics: When another user claims a design you made, you are credited a royalty on the net claim price (after payment processing costs), once, at the moment of that claim. The rate depends on your plan at that moment: 80% on Free Maker, 90% on Creator Pro and 95% on Brand Studio.

8.2 Accrual & Payouts: Royalties are recorded in your dashboard as they accrue. Royalty payouts are not yet available. Accrued royalties are not forfeited while they are unavailable. Before payouts begin we will notify makers with an accrued balance and publish the payout schedule, any minimum threshold and the identity checks required.

8.3 Circumvention: Exporting print-ready files to bypass our fulfillment while keeping a marketplace listing is a material breach of these Terms.

9.1 Processing: Payments are processed by Stripe, Inc., PCI-DSS Level 1 certified. Card details are entered on Stripe's systems and never stored on ours.

9.2 Pricing: Prices are shown on product pages and confirmed at checkout. We may update catalog pricing at any time prior to order confirmation.

9.3 Taxes & Customs: You are responsible for sales tax, VAT, GST, customs duties and import tariffs in your jurisdiction.

10.1 The Plans: Free Maker is free and is where every account starts. Creator Pro is $19.00/month or $190.00/year. Brand Studio is $49.00/month or $490.00/year. The checkout screen states the exact amount before anything is charged.

10.2 Billing: Subscriptions renew automatically through Stripe until cancelled. A paid plan grants a monthly render allowance (200 on Creator Pro, 500 on Brand Studio) that does not roll over.

10.3 Cancelling: Cancel any time; it takes effect at the end of the paid period. We do not refund part-used periods.

10.4 On Lapse: A lapsed plan returns you to Free Maker: storefront theming, collections and render quality drop to free limits. Nothing you own is taken away: designs and commercial rights under Section 5 are unaffected, permanently.

10.5 Price Changes: Any pricing change applies from your next renewal, never mid-period, and we tell you first.

11.1 Made to Order: Tees are printed after payment clears, one at a time, and ship only to addresses in the United States. Standard shipping is included in the price.

11.2 Timelines: Printing takes up to 10 days. Shipping time then depends on the carrier and the address. Any dates we give are estimates, not guarantees. We email a tracking link when the parcel leaves.

11.3 Defects & Lost Packages: Report damage, defects or misprints within 14 calendar days of delivery; see Section 12 for what's covered.

12.1 Made to Order: Apparel here is printed individually after your order is authorized, so standard off-the-shelf return rules don't apply. What follows replaces them.

12.2 The 14-Day Guarantee: Tell us within 14 calendar days of delivery and we'll reprint free or refund in full, your choice, for:

• Print faults: smearing, peeling, distortion, wrong placement or color.
• Garment faults: tears, holes, broken stitching, fabric blemishes.
• Wrong item: design, size or color that doesn't match your order.
• Transit damage: crushed, ripped or soaked in shipping.

You normally don't need to ship the faulty garment back.

12.3 Lost or Late Parcels: No tracking movement for 7 business days past the estimated delivery date means we treat it as lost and reprint/reship free. If tracking says delivered but nothing arrived, allow 24 hours, then contact us and we'll pursue the carrier claim.

12.4 Sizing & Change of Mind: Because each item is made for you, we can't accept returns for change of mind or for a garment that matches your selected size. The tees are unisex sizes; check yours before checkout.

12.5 The Claim Fee: A claim buys the design's commercial rights and your storefront. It does not include a shirt. Rights and storefront transfer instantly and cannot be unwound, so a claim is non-refundable. A printed tee is a separate order, covered by 12.2 in full.

12.6 EU & UK Buyers: The 14-day withdrawal right under EU/UK consumer law doesn't apply to personalized goods like these, but your separate statutory rights for faulty, not-as-described or unsatisfactory goods remain, in addition to 12.2.

12.7 How to Raise It: Photograph the fault (and the label, if size/item is wrong), then email support@bazaar.america.co with subject Order #[YourOrderNumber] - Defect Resolution. We review within 24–48 business hours; once verified, a replacement ships expedited or a refund lands in 3–5 business days.

12.8 Reviews: Once your tee ships, the email carries a link to rate it. Only the buyer of a shipped, unrefunded order can review it, once per order (posting again replaces it). Reviews appear on the design page with your stars, your text and the colour and size you ordered, marked “Verified buyer” and never with your name. You grant us a licence to show them there. We may hide a review that breaks Section 13; we never edit one or write one.

You agree not to:

• Infringe IP: upload or prompt artwork infringing trademarks, logos, copyrighted characters or proprietary designs.
• Harass: generate content promoting violence, discrimination or hatred against protected groups.
• Use non-consensual likeness: depict identifiable real people without their documented consent.
• Produce illicit media: pornographic, sexually explicit or illegal imagery.
• Interfere with systems: bypass rate limits, scrape, inject malicious code or attack server integrity.
• Manipulate the marketplace: wash trading, claim collusion or payment fraud.

We use automated moderation alongside human review, and may reject, unlist or remove content and terminate accounts without notice.

14.1 Notices: Under the DMCA (17 U.S.C. § 512), a takedown notice to our Designated Copyright Agent must include:

1. A signature of someone authorized to act for the copyright owner.
2. Identification of the work claimed to be infringed.
3. Identification of the infringing material, with a URL precise enough for us to find it (e.g. https://bazaar.america.co/design/[id]).
4. Your address, phone number and email address.
5. A good-faith statement that the use is unauthorized.
6. A statement, under penalty of perjury, that the notice is accurate and you're authorized to act.

14.2 Counter-Notification: If your content was removed by mistake, file a counter-notice with the same agent containing your signature, identification of the removed material and where it appeared, a good-faith statement under penalty of perjury that it was a mistake, your contact details, and consent to jurisdiction in your district's federal court (or Delaware, if outside the US). We forward valid counter-notices and may restore material in 10–14 business days unless the complainant files an action to restrain it.

14.3 Repeat Infringers: Accounts with repeated substantiated infringement notices lose access, storefronts and the ability to generate or claim designs.

Shirt Bazaar and our logo and interface motifs are trademarks of Shirt Bazaar, Inc. You may use official "Claimed on Shirt Bazaar" badges to promote your storefront.

You may not register domains, handles or entities using "Shirt Bazaar" or a confusingly similar mark without our written permission, or use our brand in a way suggesting we endorse or co-own your business.

16.1 Disclaimer of Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIRT BAZAAR AND ITS AFFILIATES, OFFICERS AND EMPLOYEES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE AI GENERATION.

16.2 Limitation of Liability: SHIRT BAZAAR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100.00 USD OR FEES YOU PAID US IN THE PRECEDING 12 MONTHS. Some jurisdictions do not allow these limitations, so they may not apply to you.

17.1 Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflicts-of-law principles.

17.2 Binding Arbitration: Any dispute arising from these Terms is settled by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Wilmington, Delaware.

17.3 Class Action Waiver: CLAIMS MUST BE BROUGHT INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING.

18.1 Reward status: Bazaar Coins are promotional, in-product rewards. They cannot be purchased, sold, transferred between users, withdrawn, redeemed for cash, or used outside the Platform. Coins do not expire, and you never have to buy anything to earn them.

18.2 Earning: You earn Coins by completing the tasks listed in the Earn coins panel of your dashboard, by the daily check-in, and through the Referral Program in Section 19. We check most tasks against your account before paying. Tasks we cannot check, such as following Shirt Bazaar on social media, are paid on trust. Each one-time task pays once per account, the daily check-in pays once per calendar day in Coordinated Universal Time (UTC), and the amount shown in the panel is the amount paid. We may withhold or reverse Coins tied to fraud, abuse, multiple accounts, a refunded or reversed transaction, or a breach of these Terms.

18.3 The house-stock spin: A spin uses the number of Coins shown before you play. The designs in the machine are a rotating selection owned by Shirt Bazaar, refreshed on the schedule shown on the Coins page. Each result is decided by us at the odds published on the Coins page at the time of the spin, and the reels then show that result. Three of the same design on the payline transfers that design to you as a Genesis Claim under Section 4, on the ownership terms of Section 5. Two alike award the render credits shown. Any other result returns the published share of your Coins. A spin never awards a design owned by another maker. We may change the odds for future spins, but the odds displayed when you play govern that spin.

18.4 Delivery of a spin award: A design won in a spin is delivered by email with its print-ready file. No price is charged for it. Render credits won in a spin join your existing credit balance.

18.5 No time pressure: Spins have no countdown and no expiring Coin balance. The daily check-in is optional, and missing a day costs you nothing. The age requirement in Section 2.1 applies.

19.1 How it works: Your referral link is in Settings, under Referrals. When someone opens it, we record the referral for 30 days using a cookie described in our Cookie Notice.

19.2 Rewards: You receive Coins when a person you referred claims their first design and when they start a paid plan, and they receive Coins when they claim their first design through your link. The amounts are those shown in Settings, under Referrals, when the qualifying action happens. Referral rewards are paid in Coins under Section 18, never in cash or as a discount.

19.3 Fair use: Referring yourself, or an account you control, is not allowed. We use automated checks, including network information, to detect abuse (see our Privacy Policy). We may withhold or reverse referral Coins for abuse, and for purchases refunded within 30 days.

19.4 Changes: We may change or end the Referral Program for future referrals. Coins already paid stay in your balance unless they are reversed under Section 19.3.

20.1 Applying: Creators may apply through the Creator Partnership Program page. Applying creates no obligation for you or for us, and we decide which applications to accept.

20.2 Separate agreement: An accepted partnership is governed by a separate written agreement. For its subject matter, that agreement takes precedence over these Terms. Anything it does not address is governed by these Terms.

20.3 Ownership: Partners follow the same ownership and royalty rules as every other user, in Sections 4, 5 and 8. Being a partner does not by itself give you ownership of any design.

20.4 Disclosure: Partnership benefits, such as a complimentary plan, are a material connection with Shirt Bazaar. When you promote Shirt Bazaar you must disclose that connection clearly, as the U.S. Federal Trade Commission's Endorsement Guides require, for example with "#ad" or "Shirt Bazaar partner".

21.1 Amendments: We may modify these Terms at any time. Material changes are posted here with an updated "Last Updated" date and, where appropriate, direct notice by email. Continued use after changes take effect means you accept them.

21.2 Termination: You may stop using the Platform and delete your account at any time from your dashboard's Security settings. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Platform or other users. Sections that by their nature should survive, including ownership of claimed designs (Sections 4 and 5), accrued royalties (Section 8), disclaimers and limits of liability (Section 16) and dispute resolution (Section 17), survive termination.

21.3 Contact: For legal inquiries or formal notices:
